TERMS AND CONDITIONS

  The Subscriber warrants that:

  1. consumer credit information for lawful purposes subject to Section 68 of the National Credit Act (NCA) read with Regulations 18(4) and 18(5) and for any other purpose that the Credit Bureaus and Accountability is lawfully entitled to disclose the consumer credit information held by it to the subscriber.
  2. It will at all times comply with the requirements for the receipt, compilation and reporting of information as prescribed by the NCA and any other legislation.
  3. It shall, when using the services of the Credit Bureaus and Accountability, have obtained all consents required by the NCA.
  4. It will give its customers/consumers 20 business days’ notice of its intention to submit adverse consumer credit information in respect of the customers/consumers to the Credit Bureaus and Accountability.
  5. It has taken reasonable steps to ensure that the information it reports to the Credit Bureaus and Accountability is accurate, up-to-date, relevant, complete, valid and not duplicated.
  6. It will not submit consumer credit information in respect of a debt that has been prescribed in terms of the Prescription Act 68 of 1969, to the Credit Bureaus and Accountability.
  7. It does not and will not (unless lawfully entitled to do so) take an upfront fee to remove or clear a person’s name from the records of a Credit Bureau.
  8. Any adverse consumer credit information submitted by it to the Credit Bureaus and Accountability does not form part of any dispute between it and its customer/consumer.
  9. It shall not (and only where it is necessary) without the consent of the consumer, transmit personal information to the Credit Bureaus and Accountability in respect of the consumer. The Credit Bureaus and Accountability may share such information with other registered credit providers and its customers for the purposes required or permitted by the NCA.
  10. Any information conveyed by it to the Credit Bureaus and Accountability may be used by the Credit Bureaus and Accountability in the normal course of its business as registered Credit Bureaus. It may be accessed and used by other Credit Providers and customers of the Credit Bureaus and Accountability.
  11. All users accessing the services of the Credit Bureaus and Accountability on its behalf have been duly authorized to do so by it.
